Restraining Orders and Prevention of Family Violence

Georgia law provides special procedures for the prevention of family violence. A victim of family violence can obtain an order from a court granting immediate relief in an ex parte proceeding at which the offending party is not present. The court then schedules a hearing with notice to the offending party. If the court finds that there has been an act or threat of violence, an order may be issued granting protection for a period up to one year.
